Court Confirms EEO-1 Pay Data Reporting Delayed Until Sept. 30

A federal district court confirmed that the U.S. Equal Employment Opportunity Commission may delay to Sept. 30, 2019, the deadline for employers to submit EEO-1 survey data on employees’ pay and hours worked for 2018, according to reports today. Other EEO-1 survey data will be due on May 31, 2019.

An earlier court order directed EEOC to collect, for the first time, data on wages and hours worked—which significantly expands the amount of data that employers are required to report. The Obama administration had sought to collect these data points before the effort was halted by the Trump administration.

Earlier this year, the American Bankers Association joined other industry trade groups in urging the Senate to confirm Janet Dhillon to be a member of the EEOC. Dhillon’s confirmation would result in a quorum being present at the EEOC, strengthening the agency’s ability to modify or rescind the expanded EEO-1 data fields.
